FOREWORD


 Education Law section 310 provides that any person considering himself aggrieved by an action taken at a school district meeting or by school authorities may appeal to the Commissioner of Education for a review of such action.

In order to provide orderly and expeditious procedures for the presentation and defense of such appeals, and for the conduct of proceedings for the removal of school officials pursuant to Education Law section 306, the Commissioner of Education has from time to time promulgated regulations governing the practice to be followed.

With the hope that ready access to the regulations will be of assistance to those wishing to bring appeals to the Commissioner, to those against whom such appeals may be brought, and their attorneys, the regulations and the applicable statutory provisions are set forth in this pamphlet.

Although reasonable efforts have been made to ensure that the statutory provisions and regulations referenced herein are current, complete and accurate, they may be subject to change, without notice.

The official version of the Education Law is published in McKinney’s Consolidated Laws of New York and the official version of the regulations is published in Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR).
